New York’s Labor Law 240(1) covers Employees, not Volunteers. New York’s employee protection scaffold law, Labor Law §240(1), makes all contractors and owners and their agents (except for owners of one and two-family dwellings who contract for but do not direct or control the work) responsible for work-site safety practices. However, in a recent case decided by the New York Court of Appeals, light has now been shed on who is and is not a protected employee.
